Engineer Agreement
1. Introduction
1.1 This Engineer Agreement ("Agreement") sets out the terms on which you, as a self-employed tradesperson, access and use PlumbGo.live ("the Website") and the PlumbGo platform ("the Platform").
1.2 The Website and Platform are operated by PlumbGo Ltd (the Company), a private limited company registered in England and Wales under company number 17094157, with its registered office at 7 Moor Lane, Cleadon, Sunderland, England, SR6 7TN. After this first reference, PlumbGo Ltd is referred to as "the Company".
1.3 By creating an account, completing registration, or using the Platform, you agree to be bound by this Agreement.
2. Definitions
In this Agreement:
- "Engineer" means any self-employed tradesperson using the Platform.
- "Homeowner" means any consumer using the Platform to locate or contact an Engineer.
- "User" means any individual accessing the Website or Platform.
- "Real-time availability" means the availability indicators displayed on the Platform, updated by Engineers, and provided for general informational purposes only.
- "Services" means the connection and visibility services provided by the Platform.
3. Independent Contractor Status
3.1 You acknowledge that you operate as an independent, self-employed contractor.
3.2 Nothing in this Agreement creates an employment, worker, agency, partnership, or joint venture relationship between you and the Company.
3.3 You are solely responsible for:
- your tax obligations;
- your insurance;
- your regulatory compliance;
- your business activities;
- any subcontractors you engage.
3.4 You must not represent yourself as being employed by, affiliated with, or acting on behalf of the Company.
4. Use of the Platform
4.1 The Platform enables Engineers to display their profile, availability, and contact details to Homeowners.
4.2 The Company does not:
- guarantee any level of visibility, responses, or work;
- set your prices or terms of service;
- verify your qualifications or insurance;
- enter into any contract on your behalf;
- mediate disputes between you and Homeowners.
4.3 Any agreement for works, pricing, or attendance is strictly between you and the Homeowner.
5. Real-Time Availability
5.1 Real-time availability displayed on the Platform is provided for general informational purposes only.
5.2 It does not guarantee that you will receive job requests, responses, or work.
5.3 You are responsible for ensuring that your availability is accurate and updated.
5.4 The Company is not liable for any consequences arising from inaccurate availability information.
6. Your Obligations
6.1 You agree to:
- provide accurate and truthful profile information;
- maintain valid public liability insurance at all times;
- comply with all applicable laws, regulations, and industry standards;
- communicate professionally with Homeowners;
- attend appointments you accept or notify the Homeowner promptly if unable to attend;
- ensure any subcontractors you engage meet the same standards;
- keep your account secure and your contact details up to date.
6.2 You are solely responsible for the quality, safety, and outcome of your work.
7. Documentation
7.1 You must provide accurate documentation upon request, including:
- identity verification;
- trade qualifications and certifications;
- public liability insurance;
- registration with relevant trade bodies (where applicable).
7.2 The Company does not verify or guarantee the validity of any documentation submitted.
7.3 You must immediately notify the Company of any change to your insurance, qualifications, or business status.
8. Conduct
8.1 You must:
- behave professionally and respectfully towards all Users;
- avoid discriminatory, abusive, or unlawful behaviour;
- respect Homeowners' privacy and property;
- refrain from soliciting Homeowners for activities outside the Platform's purpose.
8.2 The Company may take action against any Engineer found to be in breach of this clause.
9. Fees and Subscriptions
9.1 The Company may charge subscription or usage fees for access to the Platform.
9.2 All fees are governed by the PlumbGo Subscription & Billing Terms.
9.3 The Company is not responsible for payments between Engineers and Homeowners.
10. No Guarantees
10.1 The Company does not guarantee:
- job requests;
- responses;
- visibility;
- income;
- business performance.
10.2 Your success on the Platform depends entirely on your own conduct, performance, and interactions with Homeowners.
11. Liability and Indemnity
11.1 To the fullest extent permitted by law, the Company accepts no liability for:
- any loss, damage, or injury arising from your work;
- any dispute between you and a Homeowner;
- any loss of income, business, or opportunity;
- any indirect, consequential, or economic loss.
11.2 You indemnify the Company against any claims, losses, or costs arising from your work, conduct, or use of the Platform.
12. Suspension and Termination
12.1 The Company may suspend or terminate your account if you:
- breach this Agreement;
- provide false or misleading information;
- receive serious or repeated complaints;
- behave unprofessionally;
- misuse the Platform.
12.2 Suspension or termination does not entitle you to any refund of fees.
12.3 You may terminate this Agreement at any time by closing your account in line with the Subscription & Billing Terms.
13. Changes to This Agreement
13.1 The Company may update this Agreement from time to time.
13.2 The latest version will be published on the Website.
14. Governing Law
14.1 This Agreement is governed by the laws of England and Wales.
14.2 The courts of England and Wales have exclusive jurisdiction.
